Kind of the same situation that game developers are/were up against. Grumman, North American, Vought, Lockheed, Consolidated, Boeing, you name it all jumped up the a$$ of guys using their product or likenesses of to promote for profit calling it "Trademark Infringement" Tho, many of these trademarks ran out years ago the aircraft makers saw $$$ signs. It was once rumored that a model airplane would have to sell for $400.00 to assure that the makers of the original design could make their money being paid to them by CGI game developers, model makers and ANYONE that used their likenesses to promote for profit. Many 'spawned' companies that have been using these designs for years and years with prior permission from the manufactures were ready to close shop for obvious reasons.
I don't know where it's at, at this time, I think it got tossed out of federal court, let's hope and not just because it's a simple airplane model or flight sim but because it sets a president and Shelby obviously was made aware of this or....
Even though it's not exactally the same as the SAAC/Shelby thing it has one thing in common, money.
Personally, if this is true about Shelby, I wouldn't take the time to spit in his mouth for the mere utterance of "Trademark Infringement" Sorry but it urks my a$$!!!
